The ninth circuit court has maintained a ban on deploying national guard in the Oregon city, after a latest court ruling.

Judicial Panel Agrees to Reconsider Legal Matter

The ninth circuit court of appeals ruled on this week that it would rehear the case concerning the executive power with an expanded panel of eleven justices. The judicial body also overturned a previous decision from a three-judge panel that had sided with the federal government.

Ongoing Dispute Over Troop Deployment

This legal directive represents the most recent development in a protracted legal battle over whether the former president has the authority and justification to send national guard forces in Portland. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was initiated in response to ongoing demonstrations.

Conflicting Arguments

The federal government has claimed that government employees at the ICE facility in south Portland were facing threats, while city and state officials assert that local officers have command of the circumstances.

Contrary to descriptions of the city as a conflict zone, residents have been sharing videos of scenic paths and a thriving food scene, and planning events such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a federal judge in Portland enacted two temporary restraining orders this month – one preventing the federal control of the state troops, and another stopping the deployment of any national guard troops in Oregon, after attempts to evade the first order by mobilizing out-of-state forces.

On the previous day, the appeals court had temporarily suspended the initial decision – permitting control of 200 Oregon national guard – but the second ruling remained in place, preventing the physical sending of the forces.

En Banc Review

The Tuesday decision means the matter will be heard by the full court – with all decisions under review together – by a panel of eleven justices.

“This ruling demonstrates that the truth matters and that the judicial system are striving to hold this administration accountable. The constitution limits the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the state attorney general in a statement.

“The court is sending a clear message: the president cannot send the armed forces into American urban areas without cause. We will continue defending Oregon’s laws, principles, and sovereignty as this case progresses and our fight continues in the courts.”
